Marijuana is legal for medical use with a prescription in 13 states now — a legal shift that has employers wondering what to do with workers who smoke weed for wellness, writes Tresa Baldas for The National Law Journal. “They’re dazed and confused about their obligations to workers who use pot for health reasons.”
As is the case with many legal issues in the workplace, there’s no black and white answer. Although some court cases have supported employers’ right to fire workers who test positive for marijuana use even if they have a prescription and use it only outside of work hours, “I think it’s still risky to just fire someone for using it,” said attorney Danielle Urban.
